1. Liabilities and Warranties
1.1 holidayhavens.co.uk accepts no liability for the completeness or accuracy of any advertisements supplied by advertisers for insertion on the holidayhavens.co.uk website.
1.2 holidayhavens.co.uk cannot warrant the accuracy of any content or information supplied by an advertiser and hereby disclaims any responsibility for error, omission or inaccuracy in this material.
1.3 It is acknowledged by the advertiser that holidayhavens.co.uk makes no warranties or representations with regard to any of the contents which have been supplied by the advertiser and there is no implied warranty as to the fitness of the property for any particular purpose.
1.4 holidayhavens.co.uk is not liable for any failure or alleged failure in the availability of the booking or provision of the property to include but not limited to bankruptcy, sequestration, liquidation, or cessation of trade or any company, firm or individual which owns the properties.
1.5 holidayhavens.co.uk will not accept liability for any breaches, alleged or proven, of contract on an advertiser’s part and the advertiser indemnifies holidayhavens.co.uk against all costs, expenses and losses resulting from a claim relating to the content of an advertisement.
1.6 holidayhavens.co.uk does not warrant that the operation of the holidayhavens.co.uk website will be uninterrupted, error free and free from viruses and other harmful components. Whilst every attempt will be made to keep the website operational holidayhavens.co.uk will not accept responsibility for any loss of profits, salary, revenue suffered by an advertiser caused by inaccessibility or errors on the website.
1.7 holidayhavens.co.uk’s liability for any breach of the Terms and Conditions is limited to the amount actually paid (if any) by an advertiser for the use of the services provided by the holidayhavens.co.uk website.
1.8 holidayhavens.co.uk reserves the right to temporarily suspend access to the holidayhavens.co.uk website for maintenance purposes.
1.9 The words 'permenent' listing feature is descretionary and is subject to the full terms & conditions specified here.
1.91 The 'permament listing feature' will ensure that listings added that comply with our terms and conditions remain active for the duration of the HolidayHavens.co.uk website existence. However, we cannot be held responsible for problems outside of our network and areas where HolidayHavens.co.uk has no direct influence, such as backbone provider failures, fibre-optic main line cuts, DNS or Registrar problems, domain name expiration, bandwidth issues, routing problems between clients´ location and our WebHost.
1.92 The 'permenent listing feature' is also not applicable if the service interruption/data loss was caused by any natural or unnatural events that HolidayHavens cannot directly influence.

2. Content
2.1 holidayhavens.co.uk reserves the right to determine the layout, design and functionality of the holidayhavens.co.uk website.
2.2 holidayhavens.co.uk reserves the right to amend material advertisers submit before publishing on the holidayhavens.co.uk website.
2.3 holidayhavens.co.uk reserves the right to amend any material entered onto the holidayhavens.co.uk website by its advertisers. holidayhavens.co.uk will not be held responsible for any damage or loss resulting from the design or positioning of the properties.
2.4 The property in an advertisement may not be substituted by another property.

3. Copyright
3.1 It is the advertiser's responsibility to obtain permission to reproduce all photographic and other material used in their advertisements. The advertiser warrants that he is the owner of the copyright of such material or has been granted authority by the owner thereof to supply such material to holidayhavens.co.uk for inclusion on the website.
3.2 holidayhavens.co.uk cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertisers and the advertiser indemnifies holidayhavens.co.uk against any action brought for breach of copyright or other rights from the use of such material supplied by the advertiser.
3.3 holidayhavens.co.uk claims copyright to the electronic images of the photographic material supplied by advertisers.
3.4 holidayhavens.co.uk retains the right of copyright over the advertisements placed on the holidayhavens.co.uk website and shall be entitled to reproduce part or whole of any photographic material supplied by the advertiser advertisers are permitted to print and use the material for their own use.

4. Removal of adverts
4.1 Property adverts placed on the holidayhavens.co.uk site are subject to a fee and are displayed for an agreed subscription period dependant on the fee paid. holidayhavens.co.uk reserve the right to remove any advertisement without notice to the advertiser when the agreed subscription period paid for comes to an end.
4.2 If advertisers wish to have their advertisement removed from the holidayhavens.co.uk site before the end of their subscription period this will be done but no refunds will be issued.
4.3 holidayhavens.co.uk is not responsible for any of the images that appear on the website should they be deemed offensive. Holidayhavens.co.uk reserves the right to remove any pictures that are deemed offensive. Whilst holidayhavens.co.uk will endeavour to remove any offensive material it will not be liable for any upset or offence caused by the material to any individual prior to its removal from the website.
4.4 holidayhavens.co.uk reserves the right to remove any material found to be in breach of copyright laws and to remove any unsuitable material. In these events no refunds will be given.
4.5 If advertisers persistently misuse the system holidayhavens.co.uk reserve the right to remove their material from the holidayhavens.co.uk website. No refunds will be given.
4.6 holidayhavens.co.uk reserve the right to refuse any advertisement and will not be held liable for any loss or expense incurred.
4.7 holidayhavens.co.uk reserve the right to remove any advertisement following a complaint from a person who has rented an advertiser’s property which holidayhavens.co.uk consider is justified. In this event no refunds will be given.
4.8 holidayhavens.co.uk reserves the right to remove the advertisements(s) of any advertiser who is found to be in breach of any of these Terms and Conditions, no refunds will be given.
4.9 holidayhavens.co.uk reserves the right to remove the advertisements(s) of any advertising agent who does not commit to the proposed rental agent package. The Free trial is not available to rental agents or management companies listing multiple properties.
4.8 holidayhavens.co.uk reserves the right to suspend any advertisement during any account dispute.

5. Payment
5.1 Payment must be in British Pounds.
5.2 Inclusion of an advertisement on the holidayhavens.co.uk website is dependant on cleared funds being received by holidayhavens.co.uk within 14 days of the advertisement appearing. If cleared funds are not received by holidayhavens.co.uk in that time, holidayhavens.co.uk reserve the right to remove the advertisement without notice.
5.3 Payments for renewals of subscription must be received in cleared funds within 14 days of the expiration of the previous subscription, if cleared funds are not received the advertisement will be removed from the website without further notice to the advertiser.
5.4 Should the property owner decide not to renew beyond the free trial, rental listings will be made inactive from public view on the holidayhavens search engine. Property details remain in the secure user area and can be reactivated at any time. Details will not be displayed in the HolidayHavens search engine, any reference to these listings direct URL in Google Yahoo MSN will result in a redirected page. Reactivation of each listing will incurr a small administration feeof £5 per listing. The inactivated properties can not be re-added to the website to qualify for an additional free trial, these listings will be removed as soon as identified (see section 2 content).
5.6 All new properties listed will be subject to an advertising listing and credit scheme. All New Holiday rental advertisements added to the website from this date will be pre-purchased advertisments administered via PayPal. Properties listed prior to this date who have not renewed, will be eligible for this new offer. Properties renewed on any other offer will not be eligible for refunds or transfers.
5.7 Image Support service is offered to assist with the attachment of images to inidividual property listings. The fee will ensure that upto 7 images are attached successfully to the listing id concerned and fulfill any prior agreed manipulation of images. Each seperate listing will require seperate support, support is offered per listing id.


6. Links
6.1 The holidayhavens.co.uk website contains links to other web sites ("Linked Sites"). The Linked Sites are provided for your convenience and information only and, as such, you access them at your own risk. The content of any Linked Sites is not under the control of holidayhavens.co.uk, and holidayhavens.co.uk is not responsible for, and does not endorse, such content, whether or not holidayhavens.co.uk is affiliated with the owners of such Linked Sites.
6.2 holidayhavens.co.uk reserves the right to refuse hypertext links to, or addresses of, other web sites from advertisers' pages, and to remove links or web addresses without notice at our sole discretion.

7. Miscellaneous
7.1 Rates, conditions and website material are subject to change without notice.
7.2 If any part of these Terms and Conditions is found by a court to be unenforceable or invalid the remainder are. unaffected.

8. Refunds and Disputes:
All payments to HolidayHavens are non-refundable.
